Terms of Service

These Terms of Service ("Terms") govern your use of Continuance ("the Service"), operated by Continuance. By subscribing to or using the Service, you agree to these Terms.
1. Nature of the Service
Continuance is an advisory, diagnostic, and monitoring service for AI agent infrastructure. The Service analyzes telemetry data, classifies failure patterns using the AFT Framework™, and delivers alerts, runbooks, and automated remediation signals to subscribed clients.
Continuance does not operate, control, or maintain your AI agents, infrastructure, or underlying LLM providers. The Service provides observability and guidance — not engineering outsourcing.
Important: Continuance is a diagnostic monitoring service. We carry no financial liability for token overruns, API costs, model misbehaviors, infrastructure outages, or any losses arising from your AI agents' actions — regardless of whether a failure was detected, flagged, or missed by the Service.
2. Limitation of Liability
To the maximum extent permitted by applicable law, Continuance and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
(a) LLM API token costs or compute costs incurred by your agents;
(b) Revenue loss, reputational harm, or customer churn caused by agent failures;
(c) Data loss, security breaches, or unauthorized actions taken by AI agents you operate;
(d) Failures not detected by the Service, including due to polling intervals, trace gaps, or misclassification.
Our total aggregate liability for any claim shall not exceed the monthly subscription fees paid by you in the 30 days immediately preceding the event giving rise to the claim.
3. No Guarantee of Detection
Continuance uses statistical signals, semantic analysis, and heuristic pattern matching to detect agentic failures. The Service may not detect every failure, and may occasionally generate false positives. You remain solely responsible for implementing safeguards, rate limits, and circuit-breakers in your own systems.
4. "Monitor + Respond" Tier — Scope of Response
The "Monitor + Respond" plan includes automated remediation playbook triggers (session termination signals, state flush recommendations, and restart webhooks delivered to your configured endpoint). It does not include manual debugging of your codebase, custom model tuning, or hands-on engineering intervention in your infrastructure.
The 30-minute SLA applies to incident acknowledgement — defined as delivery of an AFT classification and runbook to your Slack channel. It does not guarantee resolution within that window.
5. Data and Privacy
You are responsible for ensuring that trace data sent to the Service does not contain sensitive personal information (PII), payment data, or regulated health data without prior written agreement. Continuance processes trace telemetry solely for failure detection and does not sell or share your data with third parties.
6. Subscription and Cancellation
Subscriptions are billed monthly. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No pro-rated refunds are issued for partial months.
7. Modifications
Continuance reserves the right to update these Terms. Material changes will be communicated via email at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
